MotorCart Dealer provide registered approved automotive dealers with an online auction platform where they can purchase privately owned used cars at trade prices to supply their retail stock.

- To facilitate your use of the MotorCart Dealer Platform in accordance with our Terms and Conditions which includes sharing your information with sellers if you have placed a Bid and or won the auction.
- To communicate with you in relation to your use of our services and provide you with customer support.
- For internal administrative reasons.
- To share information with our suppliers and other third parties in order to provide you with our service offerings.
- To continually improve our business, including understanding you better through the use of data analytics.
- To enable us to provide you with advertising and marketing that we believe is relevant to you.
To use your personal information, we must have a legal basis for doing so. The legal bases that we rely upon are below. We will only use your personal information where it is necessary:
- To fulfil our obligation to provide our services to you.
- To comply with a legal obligation to which we are subject.

- Under GDPR we will store your data securely and delete after our internal three-year retention policy when and if you close your account with us.

- A seller of a car if you have placed a bid or win the auction.
- Service providers, such as, auction platform, payments processing providers, data analytics and technical support providers, data storage providers, content and data providers and customer management.

- Law enforcement agencies or authorities where we believe this is necessary for the prevention, detection, or enforcement of a crime.

The Website may include links to third-party websites, plug-ins, and applications. Clicking on those links or enabling those connections may allow third parties to collect or share data about you. (1) Agreement
1.1 By using motorcartdealer.com, you agree to adhere to the following terms and conditions coupled with our Privacy Policy. If you do not agree, you should not use our website.
1.2 When using our services, you are confirming that you are a registered automotive dealer located in the United Kingdom. The details you provide are true and current.
(2) Joining motorcartdealer.com
2.1 You first need to register with us and provide contact and company information this is governed by our Privacy Policy. This will enable us to complete any required know your customer (KYC) checks.
2.2 Once approved you will receive email confirmation, and you can then start your new stock supply.
2.3 If you are approved for a rolled up monthly fee collection, you will also need to provide company bank account details to enable fee collection; Or continue to pay invoiced fees post each car purchased via our online platform. Fees are listed later in this document.
(3) Using our platform
3.1 You can now logon and access our online platform and see a range of privately owned cars across all major brands. The cars are presented in lots, and all cars contain a consistent detailed profile. Please note that all lots have been assessed by MotorCart Dealer and contains comprehensive details, spec, history, photos and approximate collection location.
(4) The Auction and Bidding
4.1 You can save favourites and bid online, its easy thanks to our powerful proxy bidding platform, just set your maximum bid for a lot during the sale, and the platform will automatically bid on your behalf in increments of £25.00 up to your maximum. If the car exceeds your maximum bid, you will receive an alert to notify you via email or when you next log in to the auction.
4.2 If the reserve price is met or exceeded, you have secured the car and are now committed to see through the transaction of collection and payment.
4.3 If the reserve price is not met, we will present the highest offer to the seller and see if they wish to proceed, we will inform you if the seller wishes to proceed.
4.4 At this stage the sellers contact details will be provided to you and you must contact the seller directly to arrange collection and complete the sale / handover of the car purchased.
4.5 Please note, if you bid you buy and you are bound by these Terms and Conditions to collect and pay for the car within a maximum of 7 days from the date of the auction. The 7 days include Saturdays, Sundays and Bank Holidays.
(5) Inspect, Collect & Payment of the car
5.1 Full handover must be complete within 7 days of winning the auction.
5.2 Once you have arranged a date and time with the seller you need to arrange your own collection and inspection. If you need help choosing a supplier to conduct this activity, please contact us directly and we will be happy to put you in touch with a company that can facilitate.
5.3 You must pay or provide evidence of payment to the seller before the car is taken away. This payment is at the winning bid price.
5.4 If for whatever reason you are unhappy and believe that the car does not match the description and/or condition in the profile, you may choose to either (1) offer a revised price, or (2) not proceed with the purchase of the car.
5.5 The profile of the car is provided by the seller as per our Terms and Conditions in our public facing arm of the business motorcart.co.uk and we carry out a detailed review of all profiles prior to agreeing a reserve price.
5.6 We accept no liability should this situation ever arise and will not offer or pay any compensation due to any losses that may occur.
(6) Our Fees
6.1 Fees are charged on a lot-by-lot basis once the hand over is complete. Completion checks are conducted as a part of fraud prevention, boycott of fees and anti-money laundering checks (AML) post all sales.
6.2 Our fees are billed post each auction and an invoice issued or, if prior approved, on a rolled up for multiple purchases which will be charged on the first of every month where an invoice will be issued and direct debit taken.
6.3 Fees are applied for each individual car sale completion, charged in £ GBP and are plus VAT.

(7) Criminal Activity
7.1 Any identified Instances of fraud and criminal behaviour on our platform will result in account suspension and we will report such activities to the relevant authorities.
(8) Third Parties
Private Sellers
8.1 Our private sellers have agreed in their Terms & Conditions that we can share their contact details with you as the winning dealer. If requested by the seller we will share your dealership and contact details with them directly so that they can contact you directly, should it be required.
8.2 All communications between you the dealer and private sellers are subject to your own Terms and Conditions. We accept no responsibility for any deal, payment or disputes that may arise between you and the private seller.

9.1 Any links to third party products, services, websites that are not affiliated with us. We have no control over these websites, and we do not take responsibility for them, please review their own policies of using their sites directly.
9.2 Advertising from third parties. We are not responsible for any misleading or inaccurate advertisements from third parties.
9.3 Data provided by third parties. We accept no responsibility for any inaccuracies.
(10) User Content
10.1 By submitting personal data on this website or otherwise providing content to us – such as your contact and dealership information we will only use to fulfil our service offerings and own marketing campaigns.
10.2 Any personal data that you provide via the website, or we otherwise collect about you when you take up our services or use the website, are governed by our Privacy Policy.
(11) Warranties about the Website
11.1 Our website and content are provided by IN2BIKES LTD. We aim that our website will operate continuously, without interruptions or be fault-free. From time to time, we may need to make the website unavailable with or without notice to carry out maintenance or upgrade work. We accept no liability for any interruption or loss of service.
11.2 Although we use reasonable endeavours to ensure that our website does not contain or transmit any viruses or other malicious code, we do not guarantee that our website will be free from such issues. You should ensure that any device from which you access our website is protected by appropriate anti-virus software. We will not be liable for any loss or damage caused by viruses.
11.3 We make this Website, including any offer or promotion of any Service, available for United Kingdom residents only and we make no representations, guarantees or warranties that the Services are available or appropriate for use by those outside the United Kingdom.
